Attorneys from a wide range of businesses and organizations gathered at the law firm Harter Secrest & Emery LLP (HSE) today to learn about data breach. HSE sponsored the event – Data Breach: Perspectives from Law Enforcement, Legal, Auditing, and Insurance Fields – for the Central & Western New York Chapter of the Association of Corporate Counsel (ACC).

Data breaches are increasing in frequency and have taken center stage in the media. A wide variety of industries have been affected and are at risk, leading organizations to question their own data policies and their ability to respond when a breach occurs.

The program educated corporate counsel about the risks, regulatory implications and potential litigation arising from a data breach. Topics covered included:

  • Best practices for preparing for, and hopefully avoiding, a data breach, including contracts with security vendors, cyber risk insurance, and organizational readiness for a breach
  • Crisis management and reporting duties in response to a data breach
  • Internal investigations arising out of a data breach, including interaction with law enforcement and regulators
  • Indemnification claims arising from a data breach
  • Potential litigation and regulatory action
  • State and federal rules that apply
